The Deadly 100-Page Consumer Statement

Have you ever unsuccessfully disputed information on your credit report?

Assuming you have already tried disputing bad credit with Equifax, Experian, or Transunion, they likely responded by telling you they performed their “investigation” and the bad credit was “verified” by the creditor - (also known as the furnisher of information).

This usually means the bureaus are NOT going to delete that damaging information and that is will stick to your credit file - possibly for the next seven years.

In the second paragraph of a standard response, the bureaus inform you that you can write a 100-word consumer statement and attach it to your report. It looks like this:

100-word statement

This is where many people write a few paragraphs and explain the reason for the negative information. They typically state the reasons for the default and argue that they deserve to have a better credit score.

It is surely tempting to tell your side of the story and explain why you have negative items on your credit report. There probably is a good reason why you defaulted on one or two bills here and there. Perhaps you were sick or got laid off from your job. After all, why should you be punished for circumstances beyond your control?

The consumer statement sure seems like a great chance to make your case, right?

Not so fast.

Do not be misled by this “opportunity” to explain situation.

The 100 word statement may at first appear like the credit bureaus are doing you a favor. This could not be further from the truth. In fact, the 100-word statement will only make matters worse for you.

Let’s assume that you were to attach a statement like this:
“To Whom it May Concern: I am not a deadbeat like other people with bad credit. I was only late on my credit cards because I was laid off from work. This is not my fault! I got another job as soon as I could and now I caught up on all my bills and have never been late since.”

Being laid off from your job may sound like a reasonable explanation to you and me. Plus, I would give that person “extra credit” for catching up on her bills and staying current since the bad financial spell.

However, the credit bureaus and creditors read such a statement entirely different. They don’t see a good person who went through some brief and unexpected hard times - they see an irresponsible credit risk!

They see a risky person who either is not responsible enough or smart enough to set aside emergency funds to cover basic minimum payments should something go wrong financially.
Attaching a 100-word statement is really bad for three additional reasons:

  1. Such a statement confirms that Yes – you really were late on those payments.
  2. The credit bureaus will ignore any future disputes you mail because you already admitted fault.
  3. Should you apply for new credit in the future; every creditor will see your candid admission that you are not able to pay your bills during times of emergency – and therefore a bad credit risk.

As you can see, attaching a 100-word written statement to your credit report can be very damaging.

In fact, the option is only there because it was written into the original Fair Credit Reporting Act enacted in the 1970’s. Thirty years ago bankers manually reviewed credit applications and read those statements personally.

In today’s electronic financial World, most banks use computer scores and formulas to make their credit decisions. Thus, such a statement only serves as another way for the credit bureaus to ignore your credit report dispute.

In sum, ignore the temptation to tell your side of the story. Resist the urge to “justify” your being late on that credit card bill or car payment. Steer clear of adding the deadly 100-word consumer statement.

How to Buy a Home with Bad Credit

Meet Angie Caballero

Angie was totally shocked when she applied for a home loan with her bank. She had not checked her credit reports in a while and discovered that multiple creditors and collection agencies were listed on her credit file. Her debts had been bought and sold several times and some of the creditors had changed their name several times. As a result, there were many negative items being reported to the credit bureaus.

This was quite a chaotic and confusing time for Angie. Neither the bank nor the credit bureaus would explain what all the bad credit meant for her - or what she should do next.

Angie is glad she contacted Lexington Law who took the time to explain all the details about her credit reports. Plus, unlike the banks and credit bureaus, Lexington Law did not judge her for having a poor credit report.

She explained that people often feel hopeless even though bad credit is often the result of things beyond their control. Often people end up with bad because…

  • they get sick
  • the lose their job
  • they get divorced, or
  • they simply make poor choices

For Angie, once she signed up for Lexington Law, she began seeing items deleted from her credit report. Soon after, there were many negative items that Lexington was able to delete.

She describes the empowerment that you feel once you take control of your credit report. Better credit has opened doors previously closed to her such as purchasing a new home or a nice car.
